1. Introduction

These Terms and Conditions (“Terms”) govern your use of TarmacView’s drone-based PAPI (Precision Approach Path Indicator) inspection services and software (“Services”). By accessing or using our Services, you agree to be bound by these Terms.

2. Services Description

TarmacView provides:

• Software licenses for drone-based PAPI light inspection and measurement
• Full-service PAPI inspection conducted by certified drone operators
• Training programs for airport personnel to operate PAPI inspection systems
• Automated ICAO-compliant reporting and documentation

3. User Accounts

3.1 Account Registration

• You must create an account to access certain Services
• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete information during registration
• You must be at least 18 years old or have legal authority to enter into this agreement

3.2 Account Security

• You are solely responsible for all activities under your account
• Notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Software License

4.1 License Grant

Subject to these Terms, TarmacView grants you a limited, non-exclusive, non-transferable license to use our PAPI inspection software for the duration of your subscription.

4.2 License Restrictions

You may not:

• Copy, modify, or create derivative works of the software
• Reverse engineer, decompile, or disassemble the software
• Sublicense, rent, lease, or transfer your license to third parties
• Remove or alter any proprietary notices on the software

5. Data Collection and Storage

5.1 Inspection Data

When using our Services, we collect and process:

• Drone flight GPS data and telemetry
• Video recordings of PAPI light systems
• Photometric measurements and sensor data
• Airport infrastructure information

5.2 Data Storage

• All data is stored on secure AWS cloud infrastructure
• Video files are stored in Amazon S3 with encryption
• Data is retained for the duration necessary to provide Services and comply with legal obligations
• You retain ownership of your inspection data

5.3 Data Processing

• We process data solely to generate ICAO-compliant inspection reports
• Data is not shared with third parties except as necessary to provide Services

6. Full-Service Inspections

6.1 Scheduling and Execution

• Inspections are scheduled by mutual agreement
• Weather conditions and airport operations may require rescheduling
• We coordinate with air traffic control for safe operations

6.2 Reports and Deliverables

• Comprehensive inspection reports are delivered within the agreed timeframe
• Reports include angular measurements, intensity data, and calibration recommendations
• All reports comply with ICAO Doc 9157 specifications

7. Fees and Payment

7.1 Pricing

• Software license fees are billed per runway as specified in our pricing
• Full-service inspections are quoted per runway (both sides)
• Training fees are charged per session
• All prices are exclusive of applicable taxes

7.2 Payment Terms

• Payment is due according to the invoice terms
• Late payments may result in service suspension
• You are responsible for all transaction fees and taxes

7.3 Refunds

• Software licenses: No refunds after 30 days of activation
• Full-service inspections: Cancellations within 48 hours of scheduled inspection incur a 50% fee
• Training: Cancellations within 7 days of scheduled training incur a 30% fee

8. Intellectual Property

8.1 TarmacView IP

All software, reports, methodologies, and documentation remain the exclusive property of TarmacView. Our trademarks, logos, and brand elements may not be used without written permission.

8.2 Client Data

You retain all rights to your raw inspection data. We retain rights to use anonymized, aggregated data for improving our Services.

9. Warranties and Disclaimers

9.1 Service Warranty

We warrant that:

• Services will be performed in accordance with industry standards
• Inspections will comply with ICAO Doc 9157 specifications
• Software will perform substantially as described in documentation

9.2 Disclaimer

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• Services will be uninterrupted or error-free
• Results will meet your specific requirements
• All defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for damages resulting from weather delays, force majeure, or airport operational requirements

11. Indemnification

You agree to indemnify and hold TarmacView harmless from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the Services
• Your violation of any third-party rights

12. Compliance and Regulatory

12.1 Aviation Regulations

• You are responsible for obtaining necessary approvals from aviation authorities
• We operate in compliance with applicable drone regulations
• All inspections follow ICAO standards and local aviation requirements

12.2 Data Protection

• We comply with GDPR and applicable data protection laws

13. Term and Termination

13.1 Term

These Terms remain in effect while you use our Services.

13.2 Termination by You

You may terminate your account at any time by contacting us. Fees for the current period are non-refundable.

13.3 Termination by Us

We may suspend or terminate your access if:

• You breach these Terms
• Your account is inactive for 12 consecutive months
• Required by law or regulation

13.4 Effect of Termination

Upon termination:

• Your license to use the software immediately ceases
• You may request a copy of your inspection data within 30 days
• All outstanding fees become immediately due

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Slovakia. Any disputes shall be resolved in the courts of Slovakia.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TarmacView.

16.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

16.4 Assignment

You may not assign these Terms without our written consent. We may assign our rights to any successor or affiliate.
